Terms and Conditions of Use for Once Upon an RFP
1. Acceptance of Terms and Conditions
By accessing or using OUanRFP (the "Service"), you agree to be bound by these Terms and Conditions of Use ("Terms"). If you do not agree with these Terms, please do not use the Service. These Terms may be updated by OUanRFP from time to time without notice. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
2. Description of Service
OUanRFP provides a monthly subscription search service for local, state, and federal bidding opportunities.
3. Registration and User Account
3.1. To access certain features of the Service, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2. You are responsible for maintaining the security and confidentiality of your account credentials, and for all activities that occur under your account. You agree to immediately notify OUanRFP of any unauthorized use of your account or any other breach of security.
4. No Guarantees
4.1 OUanRFP does not guarantee the accuracy of listings, the quality of items or services, or the conduct of users.
4.2 OUanRFP cannot guarantee specific outcomes or results. While we strive to provide our best efforts and expertise, the results may vary depending on various factors, including individual circumstances and external influences beyond our control.
5. Fees and Payment Terms
• Fees are non-refundable.
• Subsequent month's fee will be invoiced and due on the first of the month.
• During the first two months, the contract may be discontinued with no additional fees owed.
6. Content and Intellectual Property
6.1. You retain ownership of any content you submit to the Service, but you grant OUanRFP a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform such content in connection with the Service.
6.2. All intellectual property rights in the Service, including but not limited to copyrights, trademarks, and patents, are owned by or licensed to OUanRFP.
7. Privacy
7.1. Your use of the Service is subject to OUanRFP Privacy Policy, which is incorporated into these Terms by reference.
8. Termination
After the first 60 days, you reserve the right to cancel the service without any additional fees owed.
9. Disclaimers and Limitations of Liability
9.1. The Service is provided on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied.
9.2. OUanRFP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Illinois. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [Illinois].
